Governing Law and Dispute Resolution

Governing Law and Jurisdiction These Terms and any separate agreements shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to your use of this website or purchases made herein shall be subject to the exclusive jurisdiction of the state courts located in Callaway County, Missouri, or the United States District Court for the Eastern or Western District of Missouri, as applicable, and you and ATV‑FitCovers each submit to the personal jurisdiction of those courts.

Optional Arbitration Agreement Except for small claims court matters, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in Callaway County, Missouri, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. You and ATV‑FitCovers each waive the right to a jury trial and to participate in a class action. If you prefer not to be bound by arbitration, do not agree to these Terms and do not complete a purchase.


Made‑to‑Order and Custom Goods Policy

Overview All ATV‑FitCovers seat covers are manufactured to order based on customer selections. Custom and made‑to‑order items have limited return eligibility as described below.

Buyer Responsibility Buyers must verify their vehicle’s make, model, year, trim, and seat type before ordering. If your seat is aftermarket, modified, or non‑OEM, contact us at candcsewingteam@gmail.com prior to purchase to confirm fitment. ATV‑FitCovers is not responsible for fitment issues caused by incorrect information provided at purchase or by aftermarket or modified seats.

Defective or Incorrect Items

  • Report defects or incorrect shipments to candcsewingteam@gmail.com within 14 days of delivery.

  • Provide your order number and clear photos showing the defect or incorrect item.

  • After review, approved defect claims will receive a replacement or a full refund at our discretion. We will cover return shipping for items we determine to be defective or shipped in error.

Non‑Defective Returns and Buyer Error

  • Custom made‑to‑order items are non‑refundable for buyer selection errors.

  • At our discretion, we may accept returns of unused, non‑defective custom items if: (a) you request authorization within 14 days of delivery; (b) the item is returned uninstalled, clean, and in original condition; and (c) you agree to a 20% restocking fee and to pay return shipping.

  • We reserve the right to refuse returns that do not meet these conditions.

Inspection and Refund Timing Refunds for approved returns will be issued to the original payment method within 7–14 business days after we receive and inspect the returned item.

Consumer Protection Compliance This policy is intended to comply with applicable consumer protection laws, including the Missouri Merchandising Practices Act. Nothing in this policy is intended to waive rights that cannot be waived under applicable law.


Data Security and Incident Notification

Security Measures We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction.

Incident Response and Notification In the event of a security incident involving personal data, ATV‑FitCovers will investigate promptly and, where required by applicable law, notify affected individuals and regulators in accordance with such law, including the Missouri data breach notification statute, Mo. Rev. Stat. § 407.1500. Notification timing and content will follow applicable legal requirements and may vary depending on the nature and scope of the incident.
